Terms of Service

1. Acceptance of Terms

By downloading, installing, or using RewriteCmd ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. RewriteCmd is developed and operated by Hyperstack Studio ("we", "us", "our").

2. Description of Service

RewriteCmd is a macOS desktop application that rewrites selected text using third-party AI services. The App operates locally on your Mac and connects directly to AI providers using API keys that you supply. We do not operate an intermediary server for text processing.

3. Eligibility

You must be at least 13 years old to use RewriteCmd. By using the App, you represent that you meet this requirement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Your API Keys and Accounts

• RewriteCmd requires you to provide your own API keys from supported AI providers (Anthropic, OpenAI, or Mistral).
• You are solely responsible for maintaining the security of your API keys and for all usage and charges incurred through those keys.
• API keys are stored locally in your macOS Keychain. We never transmit or have access to your keys.
• Your use of third-party AI providers is subject to their respective terms of service and usage policies.

5. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use RewriteCmd on macOS devices that you own or control.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to violate any applicable law or regulation
• Sublicense or transfer your license to any third party

6. Paid Plans

RewriteCmd offers free and paid subscription plans (Pro and Business). Paid plans are billed monthly through Stripe.

• Billing: By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
• Price changes: We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Acceptable Use

You agree not to use RewriteCmd to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Violate the terms of service of any AI provider you connect to
• Infringe on the intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Interfere with or disrupt the App or related services

8. Intellectual Property

RewriteCmd, including its design, code, and branding, is the property of Hyperstack Studio and is protected by copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Content you create or rewrite using the App belongs to you, subject to the terms of the AI provider you use.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. In summary: we do not see, store, or process the text you rewrite. All text processing occurs directly between your device and your chosen AI provider.

10. Disclaimer of Warranties

RewriteCmd is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI-generated rewrites will be accurate, appropriate, or suitable for any purpose
• Third-party AI services will be available or perform as expected

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hyperstack Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of RewriteCmd.

Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Hyperstack Studio from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to RewriteCmd at any time, with or without cause, with or without notice. Upon termination, your license to use the App ends immediately. Sections 8, 10, 11, and 12 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Paris, France.
